This website is operated by aporeei. Throughout the site, the terms “we”, “us” and “our” refer to aporeei. The use of this website and services on this website provided by aporeei are subject to the following Terms & Conditions, all parts and sub-parts of which are specifically incorporated by reference here. This document shall govern the use of all pages on this website (hereinafter collectively referred to as "Website") and the purchase of products in the same (hereinafter the "Terms & Conditions").

By purchasing our goods and/or using our services, you accept these Terms & Conditions. Please read this page carefully. By placing an order, you agree to use the store in accordance with the provisions hereof, in the version in force on the date of placing the order. Aporeei reserves the right to revise the Terms & Conditions at any time. The date of the latest update is found in the final section of this document.

aporeei provides information about its business as well as a webshop on its website which allows you to purchase original designer clothes and accessories directly from aporeei.

  1. USE OF OUR WEBSITE

By using this website and placing orders through the same you agree to use this website only to make inquiries or place orders that are legally valid. By placing an order through this website, you declare to be older than 18 years old and to have legal capacity to enter into agreements. The Company assumes no responsibility or liability for any misrepresentation of Your age. 

Please note that aporeei does not guarantee that all products presented on the website are in stock or are available for purchase and preserves its right to stop selling a product. All Products offered for sale not otherwise defined as ‘upcycled’, ‘regenerated’ or ‘reworked’ are new and unused.

We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site.   1. PURCHASING RULES AND EXECUTION OF AGREEMENT 

Information provided on aporeei online store, including information about the products, their descriptions, technical parameters, origins of fibers, manufacturing details and prices, are an invitation to conclude a contract, not an offer to sell. No agreement will exist between you and us in respect of any product unless and until we accept your order. We may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you.

To place an order, you must follow the online purchasing procedure by adding our product to the cart, proceeding to check out, filling in your contact information and clicking on “Pay now”.Soon thereafter you will receive an email acknowledging receipt of your order (the "Order Confirmation"). Please note that this does not mean that your order has been accepted; since it is an offer you make us to buy one or more products. All orders are subject to our acceptance, which will be notified through an email confirming that the product has been dispatched (the "Shipping Confirmation"). The agreement between you and us for the purchase of a product (the "Agreement") will be formalised only upon our sending the Shipping Confirmation to you.

The Agreement will only refer to those products listed in the Shipping Confirmation. We will not be obliged to supply any ordered product until shipping has been confirmed by means of a Shipping Confirmation. If a product is unavailable, we will contact you shortly, by phone or by email. If we already have received payment for such product we will refund you the amount of the purchase.

  1. PRODUCTS OR SERVICES (if applicable)

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. The colors of the products shown in the pictures on the website can differ somewhat from their actual colors. Aporeei cannot be held responsible for any such discrepancy.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

  1. PRICES AND MODIFICATIONS TO THE SERVICE

The prices and delivery costs displayed on the website include VAT. Prices for our products and delivery costs are subject to change without notice. The prices may also vary between the physical stores (our retailers) and the website. aporeei is not bound by the price until aporeei has accepted the order by sending the shipping confirmation to you. 

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. Discount codes cannot be combined or applied to already discounted items.

  1. PAYMENTS

The following payments are accepted: credit cards and debit cards. The purchases made with visa and mastercard are verified by a secure code. Please note that your card is debited with the purchase amount once you place the order. We do our best to make the website as secure as possible. All credit/debit card transactions on the website are processed using stripe, a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account once you place the order. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to aporeei, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by the payment provider as a result of payment being processed in respect of your order. 

  1. DELIVERY

We offer different shipping methods to meet your needs as further specified when you check out. The delivery costs are shown in connection with the shipping methods at the checkout stage. Dispatch of orders may take up to 7 business days for items available in stock, and up to 14 days for items made to order. We aim however to dispatch all orders as soon as possible. The delivery times do not take into account possible delays caused by payment authorization and/or on the part of the shipping company. If aporeei fails to deliver within 30 days, you have the right to cancel the purchase.

The items will be shipped to the delivery address as indicated when placing the order. It is important that you ensure your address details are correct as these cannot be modified, we cannot be held liable for lost orders related to an incorrect address or incomplete information entered on an order. Once the order has been dispatched from us, you will receive a notifying email.

You will be able to track the progress of your order via link provided in the shipping confirmation email.. The liability of the items of aporeei will be transferred to you once the order has been delivered.

Delivery to Non-EU countries can incur additional custom duties and value added taxes (VAT), which are not included in the price and shipping cost listed on our website. We are not responsible for covering these expenses.

If 15 days after your parcel is available for delivery the parcel has not been delivered for reasons not attributable to us, we will proceed to cancel the Agreement and it will therefore be terminated. Following said termination we will refund you the price paid for such products in any event within a maximum of 30 days from the date in which we deem the Agreement to be terminated. In such case, we will charge you the transportation costs arising from the shipping and termination costs.

  1. ACQUIREMENT OF PRODUCT OWNERSHIP AND ASSOCIATED RISKS

You agree to assume all risks associated with the products from the moment of their delivery. You will acquire the ownership of the products the moment we receive full payment of all amounts payable in respect of them, including shipping costs, or at the time of effective delivery if delivery takes place at a later time.

  1. RETURN & EXCHANGE POLICY

You have the right to cancel an order and return your purchase. Due to the majorly “made to order” manufacturing, purchased items can not be exchanged. You are encouraged to request a return and place a new order in a convenient size.

Once you have received your order, you have 15 days to make a return. The right to cancellation will be applicable only if and when the items returned to aporeei are in the same condition in which they were received, along with the complete original packaging, tags, labels and any other accessory related to the items. Any aporeei product that is returned faulty, damaged, dirty, used or deteriorated will not be refunded and will be sent back to the address that it has been shipped from.

If the mentioned conditions are complied with there will be a total refund in a maximum time frame of 30 days.

You can easily and conveniently handle the reconsignment of your purchased products by contacting us at hello@aporeei.works and requesting a return. We will contact you confirming or denying your request. Once your return is confirmed, place the item(s) in the original shipping box, or any other solid carton box. Close the box and tape it securely. Arrange a collection by courier provider or ship it by post. Ensure the return of the products by any secure transport. 

Please note that you must pay the shipping cost for returning the products in accordance with your right of withdrawal and exchange and aporeei has no obligation to pay such costs.  

11.1 Return of faulty products

For any defect of conformity existing upon delivery of the products, you will benefit from any mandatory provisions of, and legal rights available to you under, the laws of your country. If you think that the item you have received does not comply with the conditions stipulated in the contract, get in touch with us at hello@aporeei.works. providing relevant details of the damage in a comprehensive summary with item data. 

  1. RESALE POLICY

You may purchase products on aporeei.works for personal use only and not for resale. By placing an order in our online store, you certify that you are purchasing products for your own personal use and not for resale and that you accept the terms and conditions. Any professional activity of re-sale, agency or distribution of our products is prohibited.

  1. LIABILITY

Unless otherwise expressly provided in these T&C, our liability in connection with any product purchased on our website is strictly limited to the purchase price of said product. Any damage liability of aporeei is excluded. Exempted from this exclusion are claims of the customer related to damages to health, body and mind, or damages resulting from a violation of material contractual obligations (cardinal duties), as well as the liability for other damages which are based on intent or gross negligence of aporeei, its representatives and vicarious agents. 

In the event of a violation of material contractual obligations, aporeei liability is limited to the foreseeable and typical damage if such damage has been caused slightly negligent, unless a damage to health, body and mind is concerned. aporeei assumes no liability in case of force majeure such as war, civil unrest, lockdown, failure of electricity, telephone or internet service, natural disasters or similar events. In case of force majeure,aporeei obligations will be suspended. The contract existing between you and aporeei can, in such cases, be partially or fully terminated by either sides.

13.1 Disclaimer of warranties

aporeei cannot promise that the content of its website is free of inaccuracies or typographical errors. Neither can we guarantee that all information is up-to-date. aporeei may, at any time, amend the content of the site. We cannot guarantee problem-free, uninterrupted, timely and secure access to the site. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk. 

In no case shall aporeei, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Poland. If you are contracting as a consumer, nothing in this clause will affect your statutory rights under the current applicable law.

However, if you are a consumer and resident of any other european union country you will benefit from any mandatory provisions of, and legal rights available to you under, the laws of that country. It is noted that the european commission has established the odr platform for the extrajudicial resolution of disputes concerning contractual obligations deriving from sales contracts or online services between a consumer and a professional respectively resident and established in the european union.
